Wedding Content Services Agreement (The Content Capsule)
This Agreement is between The Content Capsule ("Service Provider") and the person booking the services ("Client")
By booking The Content Capsule, the Client agrees to the following Terms & Conditions.
1. Booking & Payment
A 50% deposit is required to secure your wedding date. Bookings are not confirmed until the deposit has been received.
The remaining 50% will be invoiced seven (7) days prior to the event, with payment due within seven (7) days after the event.
All content will be delivered once full payment has been received.
2. Cancellations & Rescheduling
We understand that plans can change. A 50% deposit is required to secure your date. If you need to cancel, please let us know as soon as possible. The deposit may be retained to cover reasonable costs and losses associated with your booking, including reserving your date and turning away other work.
If you need to reschedule, The Content Capsule will do its best to accommodate your new date, subject to availability.
3. Coverage & Delivery
Coverage includes only the hours and deliverables specified in your selected package.
Additional coverage requested on the day may incur extra fees, subject to availability and agreement.
Edited content will typically be delivered within a few days following the event, depending on the scope of coverage. All included raw footage and edited content will be delivered once full payment has been received.
Content will be provided via an online gallery or file transfer service. It is the Client's responsibility to download and securely store all files once delivered.
4. Creative Style & Revisions
By booking, the Client acknowledges The Content Capsule's creative style, editing approach and content format.
Creative decisions, including editing, music selection and storytelling, remain at the discretion of The Content Capsule, while taking into consideration any preferences discussed prior to the event.
One (1) round of minor revisions is included for edited content. Minor revisions may include adjustments to clips, sequencing or music where practical.
Additional revisions or significant changes to the original creative direction may incur extra fees, which will be discussed and agreed upon beforehand.
5. Client Responsibilities
The Client agrees to:
Provide accurate event details and a confirmed timeline prior to the event.
Ensure access to all relevant locations and venues.
Communicate any key moments, special requests or important details in advance.
Ensure relevant venues, photographers, videographers and other vendors are aware of The Content Capsule's presence and services.
Failure to provide this information may impact the content captured.
The Content Capsule is not responsible for missed moments resulting from venue restrictions, interference or circumstances outside its reasonable control.
6. Guest Participation
For services such as the Walking Guest Book, light direction will be provided to guests to encourage participation.
Participation is entirely voluntary, and The Content Capsule cannot guarantee the involvement of any particular guest or a specific number of participants.
7. Equipment & Limitations
Content is captured using a combination of smartphone and camera equipment.
While every reasonable effort will be made to capture key moments, certain circumstances may impact the final content, including:
Poor lighting conditions
Weather conditions
Venue or officiant restrictions
Guest interference
Unexpected equipment or technical issues
The Content Capsule will take reasonable precautions to maintain equipment and protect captured footage.
While every effort will be made to prevent technical issues or data loss, The Content Capsule cannot guarantee that every moment will be captured.
8. Usage & Rights
The Content Capsule retains copyright ownership of all original content captured.
The Client is granted a non-exclusive, non-transferable licence to download, share and use the delivered content for personal, non-commercial purposes, including on social media.
The Content Capsule may use selected content for portfolio, website, social media and promotional purposes, subject to any privacy preferences agreed with the Client in writing.
f the Client would prefer their wedding content to remain private, this must be communicated prior to the event.
9. Limitation of Liability
The Content Capsule will take reasonable care in providing all agreed services.
To the extent permitted by law, The Content Capsule is not liable for indirect or consequential losses arising from circumstances outside its reasonable control.
Nothing in this Agreement excludes, restricts or modifies any rights or remedies available to the Client under Australian Consumer Law.
10. Unforeseen Circumstances
In the unlikely event that The Content Capsule is unable to attend due to illness, emergency or circumstances beyond reasonable control, the Client will be notified as soon as possible.
Where practical, The Content Capsule will make reasonable efforts to arrange a suitable replacement, subject to the Client's approval.
If the agreed services cannot be provided, any applicable refunds or other remedies will be handled in accordance with Australian Consumer Law.
11. Guest Privacy & Participation
The Client acknowledges that photography and video recording will take place during the event and agrees to inform guests where reasonably practical.
The Content Capsule will respect reasonable requests from guests who do not wish to be filmed or photographed.
12. Agreement
By proceeding with payment of the booking deposit, the Client confirms they have been provided with these Terms & Conditions, have had the opportunity to review them and agree to be bound by them.
The booking is confirmed once the deposit has been received, subject to the terms of this Agreement.
